Terms of Service

By creating an account or using BandUp, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the service.

1. About BandUp

BandUp is an IELTS preparation platform operated by Quest Labs ("we", "us", "our"). The service includes AI-powered writing and speaking feedback, adaptive practice, full mock tests, and structured courses accessible at bandupielts.com and the BandUp web application.

2. Eligibility

You must be at least 13 years old to use BandUp. If you are under 18, you confirm that you have parental or guardian consent. By using BandUp, you represent that the information you provide is accurate and complete.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

You may not share your account with others or use another person's account without permission.

4. Subscriptions and Payments

Free plan

BandUp offers a free tier with limited practice sessions and features. No payment is required.

Paid plans

Pro and Unlimited plans are billed on a monthly or annual basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Free trial

If you start a free trial, you will not be charged until the trial period ends. You may cancel before the trial ends to avoid being charged.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer pro-rated refunds for partial periods.

Refunds

We offer refunds within 7 days of initial purchase if you are unsatisfied and have not consumed more than 20% of the plan's features. Contact [email protected] to request a refund. We reserve the right to decline refund requests that show evidence of abuse.

Price changes

We may change subscription prices with at least 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

6. AI-Generated Content

BandUp uses artificial intelligence to evaluate your writing and speaking responses and generate feedback. AI scores and feedback are provided for educational purposes and are not official IELTS scores. Actual IELTS band scores are determined solely by Cambridge Assessment English and authorized testing centers.

We strive for accuracy but do not guarantee that AI feedback is error-free. You should not rely on BandUp scores as a substitute for official assessment.

7. Intellectual Property

All content on BandUp — including software, design, text, practice questions, audio, and course materials — is owned by Quest Labs or our licensors and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use BandUp for your personal, non-commercial IELTS preparation. You may not copy, reproduce, distribute, or create derivative works from BandUp content without our written permission.

Your practice responses and submissions remain your own. By submitting them, you grant us a limited license to process them for the purpose of providing feedback and improving our AI models.

8. Availability and Changes

We aim to keep BandUp available 24/7 but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.

9. Disclaimer of Warranties

BandUp is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or that it will meet your specific requirements. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Quest Labs and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use BandUp, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of BandUp shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Quest Labs harmless from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your violation of these terms or your misuse of BandUp.

12. Governing Law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Pennsylvania.

13. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email or by displaying a notice in the app at least 14 days before the change takes effect. Continued use of BandUp after the effective date constitutes your acceptance of the updated terms.

14. Termination

We may suspend or terminate your account at any time for violations of these terms, fraudulent activity, or for any other reason with reasonable notice. You may delete your account at any time from the app settings. Upon termination, your license to use BandUp ends immediately.
